These terms apply to any charter reservations made on IYC.COM. Please take the time to review them carefully before you make any reservations on our website, as they set out important information concerning your and our rights and obligations.
You must agree to these terms before you place your reservation.
These terms and conditions (Terms) apply to the reservation made by you and supply of Services by us to you. They apply to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by law, trade custom, practice or course of dealing.
You must be at least 18 years old to make a reservation on our website.

We are committed to expanding our network of offices, employing the best professionals in the industry and investing in the development of proprietary software solutions, to deliver our clients unrivaled service of the highest industry standard.
We offer forward-thinking advice, insight and support to yacht owners, buyers, charterers and captains worldwide. Our focus is on leading the industry and giving new meaning to the word client-centric.

3. These terms
3.1 Any reference to ‘we’, ‘us’ or ‘our’ in these terms is to IYC, and any reference to ‘you’ or ‘your’ is to the person making a reservation on our website.
3.2 We may make changes to these terms at any time. However, the terms which apply to your reservation will be those in force at the time you submitted your order to us.
3.3 Please print out or save a copy of these terms and any emails from us for your records, as we will not save or file a copy for you. These terms are only available in English.
4. Reservations
4.1 Please check your reservation carefully and the information provided in the required fields of the Reservation Contact form before you submit it to us. Our reservation process allows you to check and amend any errors before submitting your reservation to us. Please check all details carefully before submitting. You are responsible for ensuring that the details provided are complete and accurate.
4.2 Your reservation is an offer to charter the vessel chosen for the selected period and location on the set terms. Confirmation that your reservation has been successfully submitted does not mean that it has been accepted by the owner of the vessel.
4.3 Acceptance of your request by the owner of the vessel will be confirmed via email along with the final charter cost as per your selected itinerary and charter particulars. The reservation becomes legally binding only when a legally binding contract is executed between, inter alia you and the owner of the vessel on the agreed terms.
4.4 If your reservation is not accepted for any reason, we will email you using the details you provided when you placed your reservation.
4.4 The reservation amount will be authorized and withheld for payment from the credit card you provide however NO FUNDS SHALL BE WITHDRAWN before the execution of a legally binding contract.
4.4 In case a legally binding contract has not been agreed and executed within 21 calendar days from the date that you receive the confirmation email that your reservation request has been received by IYC.
4.4 We have the right to reject any reservation for any reason.
4.4 It is your responsibility to ensure that:

5.1 The availability information presented is subject to change as a result of new information, changes in circumstances, prevailing conditions and the yacht’s schedule. We cannot guarantee the availability of any vessel or the accuracy of the information provided on the platform at any given time. Despite our best efforts to ensure all information is up-to-date, it is possible that due to the ever-changing circumstances of each vessel, an accurate real-time representation may not be possible.
5.2 In certain circumstances beyond our reasonable control, we may need to amend details relating to your selected vessel. If this happens and it affects your reservation, we will notify you by email. In such case no funds will be taken from your authorised card.
6. KYC
We note that before entering into a legally binding contract with the owner of the vessel you will be asked to provide specific documentation verifying your identity and residence (i.e. copy of passport or identification card and utility bill).
7. Descriptions and available information
7.1 Descriptions of all available vessels are set out on our website.
7.2 The indicative charter fee, available locations and other readily available information are set out on our website. Please note that this information may change at any time and although we strive to update in a timely manner, this may require a short time delay.
7.3 We are not liable to you if you are unable to make the reservation request due to a poor internet connection, because your device does not meet the minimum technical requirements, or for any other reason outside of our reasonable control.
8. Payments
8.1 Any funds authorised to be used shall remain locked for a period of 21 days.
8.2 No funds will be withdrawn before the execution of a legally binding contract.
8.3 In case a binding contract is not executed within 21 calendar days, the authorisation over the funds will be released and the reservation considered as cancelled.
8.4 The legal entities that will accept payments are the following. Which entity will do so will be determined as per the user’s reservation parameters.

9. Restrictions
You are responsible for ensuring that you comply with any local laws applicable with regards to use of our website.
10. Fees
10.1 Charter fees for each vessel are set out on our website. All fees are depicted in the currency set out by the owner of the vessel and do not include VAT, other taxes, Advanced Provisioning Allowance (to cover running costs while on board), crew gratuity, vessel relocation fees, etc.
10.2 The Charter fees provided for any vessel are estimates and may change at any time. Final charter cost details are subject to final confirmation via email by IYC. Final charter cost is calculated based on charter’s particulars, including itinerary and any other particulars as per charterer’s preferences.
10.3 The reservation fee is 5% of the total estimated Charter Fee as calculated on our website with a minimum required deposit of €2,500.
11. Payment
11.1 We accept the following credit cards and debit cards: Master Card and Visa. All credit card and debit card payments need to be authorised by the relevant card issuer. All payments will be processed by Ecommpay.
11.2 Any payment/withdrawal from your card will be effected and non-refundable only when a legally binding contract is executed with the owner of the chosen vessel.
11.3 The number of business days for the authorization to be released depends on the issuing bank or credit card provider.
12. Your right to cancel
12.1 You may notify us to cancel the reservation at any time before the execution of a legally binding contract.

13. Events beyond our control
We cannot be held responsible for any failure to adhere to these terms due to circumstances beyond our control.
14. Our responsibility to you
14.1 We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.
14.2 Nothing in these terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit.
14.3 We will not be liable to you, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the reservation for:

Any personal information that you provide to us will be dealt with in line with our Privacy Policy available here,which explains what information we collect and hold about you, and how we collect, store, use and share such information.
16. No third-party rights
No one other than us or you has any right to enforce any of these terms.
17. Transfer of rights
18.1 We may transfer our rights under these terms to another business without your consent, but we will notify you of the transfer and make sure that your rights are not adversely affected as a result.
17.2 You are not allowed to transfer your rights under these terms to anyone without our prior written consent.

19. Governing law and jurisdiction
19.1 The laws of Cyprus apply to these terms, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.
19.2 Any disputes will be subject to the exclusive jurisdiction of the Courts of the Republic of Cyprus.
